FXDE Barber Battle
Competition Entry Privacy and Consent Notice
Prepared under the Protection of Personal Information Act 4 of 2013 (POPIA). This notice applies specifically to your entry into the FXDE Barber Battle competition, and sits alongside FXDE's general Privacy Policy.
1. Why This Notice Exists
This notice explains what personal information we collect from you as part of your Competition entry, why we collect it, and what your rights are. It is separate from, and more specific than, FXDE's general Privacy Policy, because entering this Competition involves us collecting your identity number.
You must read this notice in full before you can submit your Competition entry. Our entry form only allows you to proceed once you have scrolled to the end of this notice and given the consents requested below.
2. Who Is Responsible for Your Information
The responsible party is FXDE. Our full registered entity name and registered address are available on request from customerservice@fxde.co.za.
Our Information Officer is registered with the Information Regulator and can be contacted at customerservice@fxde.co.za.
3. What Personal Information We Collect
When you enter the Competition, we collect the following directly from you:
- your full name;
- your contact details (phone number and email address);
- your South African identity number, or passport number if you are not a South African citizen or permanent resident;
- the name and location of the barbershop or store where you work or are affiliated;
- your age, or date of birth, to confirm whether you are 18 or older;
- three photographs of your haircut work, and one video of up to 60 seconds showing your skill, submitted by you as part of your application.
If you are selected as a finalist, we will also collect photographs and video footage taken during the live competition event, and additional proof of identity or trade affiliation if we reasonably need to verify your eligibility.
4. Why We Collect Each Piece of Information
We only use your information for the specific purposes below. We do not use your identity number for any other purpose.
- Your name and contact details are used to process your entry and contact you about the Competition.
- Your identity number is used solely to confirm you are a real, unique individual and to prevent the same person from submitting more than one entry.
- Your store or barbershop affiliation is used to verify your eligibility and, together with your identity number, to detect duplicate entries.
- Your age or date of birth confirms whether the parental consent process in clause 6 applies to you.
- The three photographs and skill video you submit with your application are used to judge and shortlist entries -- this use is required to enter, since we cannot assess an application without seeing your work.
- Photographs and video of finalists taken at the live event are used to run and judge the event, and, as described in clause 5, are also used for FXDE marketing as a condition of participating as a finalist.
Our legal basis for processing is your consent, given by accepting this notice and submitting your entry. Where you are under 18, our legal basis is the consent of your parent or legal guardian.
5. Use of Your Image, Video or Footage
There are three separate uses of your photos, video and footage, and they are not treated the same way:
- Judging your application (mandatory): the three photographs and skill video you submit are viewed by our judging team to assess and shortlist your entry. This is required to enter -- we have no other way to assess your work.
- Live event footage if you become a Finalist (mandatory model release): the Competition event will be filmed and photographed as a core part of how it runs. If you are selected as a Finalist, you agree that photographs, video and footage of your participation at the live event may be used for FXDE's marketing, social media and promotional purposes. This is a condition of competing as a Finalist, consistent with the public, filmed nature of the event, and is not optional once you reach that stage.
- Using your original application photos/video for marketing (optional): separately, and only with your specific opt-in consent, FXDE may use the photos or video you submitted with your application (rather than live event footage) for marketing purposes, for example if you are not selected as a Finalist but submitted strong work. This is entirely optional and declining it will never affect your entry, your judging, or your chances of being selected.
Where a Finalist is under the age of 18, the mandatory finalist media release must be given by a parent or legal guardian on the Finalist's behalf, in addition to the consent already obtained under clause 6.
6. If You Are Under the Age of 18
If you are under 18, South African law defines you as a child, and we cannot collect or use your personal information, including your identity number, unless your parent or legal guardian consents first. If you indicate you are under 18, you will be shown a separate process requiring your parent or guardian's consent before your entry can be submitted.
7. How We Protect Your Information
Because an identity number is sensitive personal information, we apply additional safeguards beyond our standard security measures:
- access to identity numbers is limited to a small, named group of FXDE staff who need it to verify entries;
- identity numbers are stored in encrypted form and are not visible in plain text in our general order or customer systems;
- identity numbers are never shared with any third party, including sponsors, media partners or venue partners;
- we keep a record of who has accessed identity number data and when.
8. How Long We Keep Your Information
We keep your identity number only for as long as necessary to run the Competition and verify the winner. We will delete all identity numbers collected for this Competition no later than 60 days after the Competition concludes, except where we must keep a record longer to comply with a legal obligation.
Photographs and footage used in FXDE marketing, where you have consented under clause 5, are kept for as long as reasonably needed for that purpose, or until you withdraw your consent.
10. Your Rights
- ask us what personal information we hold about you;
- ask us to correct inaccurate or incomplete information;
- ask us to delete your information, subject to clause 11;
- withdraw your consent at any time;
- object to our processing of your information;
- lodge a complaint with the Information Regulator of South Africa.
11. What Happens If You Withdraw Your Consent
You may withdraw consent at any time before the close of the Entry Period. If you withdraw, we will stop processing your information and your entry will be withdrawn. Withdrawing consent does not undo processing that already lawfully took place before you withdrew it.
