FXDE Barber Battle
Official Competition Rules
Prepared under Section 36 of the Consumer Protection Act 68 of 2008 and Regulation 11 of the Consumer Protection Act Regulations.
1. The Promoter
This competition, the "FXDE Barber Battle" (the "Competition"), is promoted by FXDE (the "Promoter", "FXDE", "we", "us" or "our"). Our full registered entity details and registered address are available on request from customerservice@fxde.co.za.
The Promoter is a promoter for the purposes of section 36 of the Consumer Protection Act 68 of 2008 (the "CPA") and this Competition is a promotional competition as defined in section 36(1)(d) of the CPA.
2. Definitions
- "Competition" means the FXDE Barber Battle promotional competition described in these Rules.
- "Entrant" means any natural person who submits a valid Entry in accordance with these Rules.
- "Entry" means a completed application submitted through the official Entry Page during the Entry Period.
- "Entry Period" means the period during which entries are open, as published on the official Entry Page (South African Standard Time), unless extended, shortened or cancelled by the Promoter in accordance with these Rules.
- "Prize" means the prize or prizes described in clause 7 of these Rules.
- "Rules" means these official competition rules, as amended by the Promoter from time to time.
3. Who May Enter
To be eligible to enter this Competition, an Entrant must, at the time of Entry:
- be a natural person and not a juristic entity, partnership, or group;
- be a South African resident at the time of entry;
- hold a valid South African identity number, or, where the Entrant is not a South African citizen or permanent resident, a valid passport number and supporting documentation as the Promoter may reasonably require;
- provide accurate, complete and truthful information in their Entry, including their identity number and their affiliated barbershop or store location;
- be 18 years of age or older, OR, if under the age of 18, have obtained the prior written consent of a parent or legal guardian in accordance with clause 4 below;
- actively work as a barber or be engaged in the barbering trade, and provide reasonable proof of this if requested by the Promoter.
The following persons are not eligible to enter this Competition, whether entering directly or indirectly through another person:
- directors, members, partners, employees, contractors and agents of the Promoter;
- directors, members, partners, employees, contractors and agents of any advertising, promotion, judging, event production or media agency engaged by the Promoter in connection with this Competition;
- the immediate family members (spouse, parent, child or sibling) of any person listed above;
- any person who has, in the Promoter's reasonable opinion, attempted to enter this Competition more than once using different identities, identity numbers or contact details.
The Promoter reserves the right to request reasonable proof of identity, age, residence and trade affiliation from any Entrant at any stage of the Competition, and to disqualify any Entrant who fails to provide this proof within a reasonable time when requested.
4. Entrants Under the Age of 18
Where an Entrant is under the age of 18 at the time of Entry, that Entrant is a child as defined in the Protection of Personal Information Act 4 of 2013 ("POPIA"). In accordance with sections 34 and 35 of POPIA, the Promoter will not process the personal information of any Entrant under the age of 18 unless a parent or legal guardian of that Entrant has first provided valid, informed consent in the manner set out in the Competition Entry Privacy and Consent Notice.
An Entrant under the age of 18 may not complete the Entry Page alone. The Entry Page will direct any Entrant who indicates they are under 18 to a separate process requiring a parent or legal guardian to provide consent before any Entry can be accepted or processed.
5. How to Enter
Entry is open only during the Entry Period. To enter, an Entrant must visit the Entry Page, read and accept the Competition Entry Privacy and Consent Notice in full, complete all required fields truthfully, and submit before the close of the Entry Period.
No purchase of any FXDE product or service is necessary to enter this Competition. Entry is free of charge, save for any data or airtime costs the Entrant may incur in accessing the internet to submit their Entry.
Each Entrant may submit only one Entry. The Promoter uses the identity number and store location supplied at Entry to identify and prevent duplicate or multiple Entries by the same person. Any Entrant found to have submitted more than one Entry will have all associated Entries disqualified.
6. Selection of Finalists and Judging Criteria
Following the close of the Entry Period, the Promoter will review all valid Entries and select the Entrants who will proceed as finalists in the live competition event (the "Finalists"). Finalists are shortlisted on the objective judging criteria set out below, applied consistently to every valid Entry.
The decision of the Promoter as to the selection of Finalists is final. Finalists will compete in a live event judged by an independent panel in accordance with the judging criteria below. The judging panel's decision as to the winner is final and binding.
Each Entry and each live cut is scored out of 100 against the following criteria:
- Fade blending and gradient control, 30 points. Smoothness of the transition, absence of lines or patches, consistency across the head.
- Line work and detailing, 25 points. Sharpness and symmetry of outlines, edge-ups, partings and any freehand detail.
- Finish and cleanliness, 20 points. Neck and ear work, removal of stray hair, styling, and the overall presentation of the finished cut.
- Technical control and tool use, 15 points. Blade and guard selection, sectioning, posture, hygiene and safe, confident handling of tools.
- Creativity and overall impression, 10 points. Suitability of the cut to the client, originality, and the overall impact of the finished look.
Finalists compete within a published time limit set by the Promoter on the day of the live event. Judges score independently and scores are totalled; in the event of a tie, the Entrant with the higher score for fade blending and gradient control is placed higher.
7. Prizes
The prize description and value for each prize category are published on the official Entry Page and in the advertising for the Competition, and apply exactly as advertised there.
The Prize is not transferable, may not be sold or exchanged, and, save where required by law, no cash alternative will be offered in substitution. Any tax liability arising from a winner's receipt of the Prize is the sole responsibility of the winner.
8. Winner Notification
The Promoter will attempt to notify the winner using the contact details supplied at Entry. If the Promoter is unable to make contact within 7 (seven) days of the announcement, the Promoter reserves the right to disqualify that winner and select an alternate, and the original winner will forfeit any claim to the Prize.
9. Use of Image, Name and Footage
This Competition will be filmed and promoted as part of FXDE's marketing activities. Separately from the mandatory processing described in the Privacy and Consent Notice, the Promoter will request each Finalist's specific, separate consent to use their name, image, voice and footage for marketing purposes. This consent is not a condition of entering the Competition or being selected as a Finalist.
10. Disqualification and Liability
The Promoter may disqualify any Entrant or Finalist at any stage where that person has provided false or misleading information, attempted to enter more than once, engaged in fraudulent or unlawful conduct, does not meet the eligibility requirements, or fails to comply with these Rules in any material respect.
To the fullest extent permitted by law, the Promoter will not be liable for any loss, damage, injury or disappointment arising from entry into or participation in this Competition, except to the extent such liability cannot lawfully be excluded. Nothing in these Rules limits any right an Entrant has under the CPA that cannot lawfully be excluded.
11. Availability, Amendment and Cancellation
A copy of these Rules is available free of charge to any person on request, and is published here for the duration of the Competition and for a reasonable period thereafter. The Promoter will retain a copy of these Rules, together with records of Entries received, for not less than 3 (three) years after the end of the Competition, and will make them available to the National Consumer Commission on request.
The Promoter reserves the right to amend these Rules where reasonably necessary, and to cancel, suspend or terminate this Competition at any time where circumstances beyond its reasonable control make it necessary.
12. Personal Information
The Promoter's collection and use of personal information submitted as part of this Competition is described in full in the Competition Entry Privacy and Consent Notice, which forms part of these Rules by reference.
13. Governing Law and Contact
This Competition and these Rules are governed by the laws of the Republic of South Africa. Any dispute is subject to the exclusive jurisdiction of the South African courts. For any query, contact FXDE at customerservice@fxde.co.za.
